California Supreme Court Delivers Landmark Victory for Bicyclists in Whitehead v. City of Oakland Case No. S284303

Ruling Strengthens Legal Protections and Reinforces Cities’ Responsibility to Maintain Safe Roads

Oakland, Calif., May 2, 2025 — In a powerful affirmation of bicyclists’ rights, the California Supreme Court has ruled in Whitehead v. City of Oakland (case S284303) that public entities cannot rely on liability waivers to avoid responsibility for dangerous road conditions. The decision marks a major legal milestone for bicycle safety and public accountability across the state.

The case involved cyclist Ty Whitehead, who suffered a traumatic brain injury during a charity training ride after hitting a large, obscured pothole on Skyline Boulevard in Oakland. Although Whitehead had signed a release form as part of the event, the Court ruled that such waivers cannot excuse a city from its statutory duty to maintain safe public roads. The Court unanimously found that exempting cities from liability in these cases violates California Civil Code section 1668, which prohibits contracts that waive responsibility for a violation of the law.

A pivotal amicus curiae brief supporting Whitehead was submitted by renowned bicycle attorney Shaana Rahman, founder of Rahman Law PC in San Francisco. Rahman authored the brief on behalf of San Francisco Bicycle Coalition, California Bicycle Coalition (CalBike), and Bike East Bay, offering the Court a critical perspective on the real-world impact of road hazards on bicyclists and the importance of holding cities accountable for infrastructure safety. The brief helped underscore how releasing cities from liability would endanger cyclists and undermine public safety efforts statewide.

“This decision is a win not just for one rider, but for every Californian who uses a bike to get around,” said Shaana Rahman, bike lawyer and founder of Rahman Law PC. “It sends a clear message that cities must take their responsibilities seriously—especially when it comes to keeping cyclists safe.”

The ruling clarifies that municipal liability cannot be sidestepped through fine print and reaffirms that cyclists are entitled to the same legal protections as any other road user. It is especially significant at a time when more Californians are choosing bicycles for health, transportation, and environmental reasons.

Organizations across the state have applauded the Court’s decision. Shaana Rahman is calling it “a critical step forward for equity, accountability, and the safety of all who share our roads.”

Conquer Your Fear of Cycling in the City

In a podcast a few years back, principal and founder of Rahman Law, Shaana Rahman, mentioned the fear she had when first riding in San Francisco.  There were new ins and outs that she had to learn including how to cross railcar tracks safely (go straight across) and negotiate busy intersections.  Urban riding can be dangerous, but we’ve pulled together some great tips for you to conquer your fear of cycling in the city. 

  • Plan your Route in Advance

A lot of people skip this step when riding and just take the same route they would take in a car.  But riding a bike in the city may cause you to take a different route to stay within safe riding areas and minimize the number of obstacles you’ll face.  There are several interactive maps available online to help you mitigate your chances of an injury including the Vision Zero Hight Injury Network Map: https://sfgov.maps.arcgis.com/apps/OnePane/basicviewer/index.html?appid=335c508503374f5d94c95cb2a1f3f4f4 and the SF.gov map: https://sfgov.org/scorecards/transportation/traffic-fatalities. 

If you live and/or work in an injury corridor, you may not be able to avoid all of the intersections known to be dangerous, but you will know to be extra alert when passing through.  Awareness and planning can really help reduce the fear of cycling in the city.

  • Practice Outside of Rush Hour

If you’re planning a new route or riding for the first time in a while, it will help you conquer your fear by riding outside of the rush hours before and after work and at lunch.  Try riding first thing Saturday morning when there is less traffic as you become familiar with your route.  Or for an even more positive experience, try riding your route a few times with a friend.  Remember to ride in line and not side-by-side. 

  • Be Visible

When riding at night in California, a headlight is required plus a rear reflector or red light along with the standard side-facing reflectors on both sides of the bicycle.  And while the lights and reflectors required by California law are a great start, the more visibility you can give yourself, the safer you’ll be.  Invest in a reflective jacket you can wear over your work clothes if you plan on being a cycling commuter.  You can also put lights on during daytime riding, especially in foggy San Francisco, for an extra layer of visibility.  You can also add reflectors to your helmet if it doesn’t include them already. 

  • Practice Hand Signals and Obey Traffic Laws

If it’s been a while since you last used hand signals, there’s a refresher for you here: https://www.bikemn.org/mn-bicycling-handbook/hand-signals/.  Remember to use your hand signals to let the traffic around you know that you’ll be moving into or across their lane.  And always obey traffic lights and signs.  Being on a bicycle does not mean road rules are optional.  You can brush up on your road rules in California here: https://www.dmv.ca.gov/portal/handbook/california-driver-handbook/.

  • Use the Vehicle Travel Lane When Needed

You may not find wide bicycle lanes available throughout your planned route, though San Francisco has been increasing the visibility of these lanes where possible as part of the Vision Zero initiative.  If you’ll be riding along lanes of parked cars, be prepared to use the vehicle travel lane by always giving yourself a safe escape window while riding.  Parked cars can lead to open doors and opening doors can lead to injuries. You have the right to use the vehicle travel lane when needed. 

Conquering any fear takes work.  Taking the time to plan your route, practice it, and being familiar with traffic laws can all help you be more confident when you take to two wheels in the city.  We also recommend having our phone number saved in your phone in case of a collision.  Call 911 first if there are any injuries, gather as much information as you can on the scene, then give us a call if you need help reclaiming damages from a broken bicycle or injury.  We’re personal injury lawyers and we’re here to help.  Consultations are free.

Rahman Law PC Sponsors Walk San Francisco for Pedestrian Friendly Streets

SAN FRANCISCO, Calif., FEBREUARY 23, 2022

Rahman Law PC, a personal injury law firm with offices in San Francisco and Paso Robles, California, announces their sponsorship of Walk San Francisco, an organization with the goal to make San Francisco the most pedestrian-friendly city in the United States.  Rahman Law has been a sponsor of Walk San Francisco in the past, but this year they are increasing their sponsorship engagement in support of making San Francisco safe for pedestrians. 

This year, Rahman Law will be sponsoring multiple events, including Member Walks and Crosstown Adventure Walks throughout the year, Peak2Peak in the Fall, Walk to Work Day in the Spring, and Walk & Roll to School Day in October.  Both the Crosstown Adventure Walks and Peak2Peak give pedestrians the opportunity to explore parts of San Francisco seldom seen by anyone.  The Crosstown Adventure Walks span the 16-mile route from Southeast to Northwest San Francisco, which fully opened in 2019.  The Peak2Peak walk follows a secret, unique route across hidden trails with off-the-beaten-path treasures put together by Walk San Francisco.

Of all of the events being sponsored, Walk to Work Day and Walk & Roll to School Day are the favorites for Rahman Law because they engage the entire community.  Shaana Rahman, a personal injury lawyer and the principal and founder of Rahman Law, frequently volunteers to work at a booth for Walk to Work Day handing out tote bags and chatting with pedestrians on their way to work.  Walk & Roll to School Day invites teachers, parents, and kids to engage in transportation that is good for the environment and community while having fun participating with friends and classmates.

SAN FRANCISCO, Calif., April 2, 2019 (SEND2PRESS NEWSWIRE) — San Francisco Personal Injury Attorneys, Rahman Law PC, are pleased to announce their repeat sponsorship of Walk San Francisco’s annual Walk to Work Day. The event will take place Wednesday, April 10, 2019 between 7:30 a.m. and 10 a.m. Last year’s event was the biggest ever and participation is expected to increase again this year. San Francisco was the first city in the nation to officially celebrate Walk to Work Day in 2013 and Rahman Law PC has participated in or sponsored the event for the past 6 years.

Walk to Work Day was introduced by Prevention Magazine in 2004 to encourage walking as an everyday part of a healthy lifestyle. San Francisco made Walk to Work Day official to further this mission by raising pedestrian safety awareness to make walking better in San Francisco every day. Walk San Francisco, a non-profit dedicated to making the streets of San Francisco a more livable, walkable shared public space, supports Walk to Work Day with Hubs where volunteers give out freebies, coffee, and prizes for commuters who participate.

As with last year, Walk to Work Day 2019 will include a rally at City Hall at 9 a.m. to give pedestrians an opportunity to ask City leaders to make the streets safer for everyone.
